Please note, Stuart Melzack are not retained on the majority of properties listed. Therefore in the event of you, your associates, your company, or your associated companies entering into a contract to take possession of any of the properties listed, we are entitled to look to you, for payment of our fees .

In such event our fees in respect of Leasehold premises shall be 10% of the agreed annual rental together with 5% of any premium paid.

Where properties are Freehold our fees shall be 2% of the agreed purchase price.

In all cases a minimum fee of £1,500 will apply.

All fees are subject to VAT and become payable upon exchange of contracts.

NO FEES ARE PAYABLE IF YOU DO NOT PROCEED TO AGREEING HEADS OF TERMS

Abortive Fees

In the event of our introducing property to you, where Heads of Terms are agreed between the parties, then should you:

i)  choose, for whatever reason,* not proceed with the transaction at any time thereafter
ii) fail to provide satisfactory references and / or proof of the ability to purchase, at any time thereafter

Stuart Melzack will be entitled to charge an abortive fee to cover costs, time and energy expended on the matter. Such fee will be charged at a rate of £1,500 + VAT per month from the date of instruction, to a maximum fee of £3,000 + VAT or the fee that would have become payable if the transaction had proceeded, whichever the smaller, subject to a minimum fee of £1,500 + VAT and disbursements.

* excluding the receipt of a valuation or a survey that would prohibit you proceeding with the transaction.

PLEASE NOTE – In accordance with the Money Laundering Regulations 2003 all property agents/advisers are required to obtain identification of all persons/companies and controlling shareholders on who’s behalf we are acting.

In the case of an individual we shall need to see and copy, to keep on file, a combination of

* Full Passport or National Identity Card and Full Driving Licence
* Full Passport or Full Driving Licence and Recent Bank Statement or Utility Bill
* Full Passport or National Identity Card and Recent Bank Statement or Utility Bill

In the case of a Company we shall need to see and copy, to keep on file, the original Company Registration certificate together with, in respect of the controlling shareholders of the company, a combination of:

* Full Passport or National Identity Card and Full Driving Licence
* Full Passport or Full Driving Licence and Recent Bank Statement or Utility Bill
* Full Passport or National Identity Card and Recent Bank Statement or Utility Bill
